Introduction
These Terms and Conditions of Sale (“terms and conditions”) relate to and govern the purchase of products from Deep South Distillery (“we”, “us”, “our”) by you, the customer (“you”, “your”).
- Deep South Distillery (Pty) Ltd is a licenced micro-distillery based in Kommetjie, South Africa with registration number 2016/216669/07
- We offer for sale a range of products, including alcoholic and non-alcoholic beverages, foodstuffs, gifts and other items generally related to the food and beverage industry (“products”).
- Our products may be purchased directly from us:
- In person, at the Distillery
- Via our online store at deepsouthdistillery.co.za/shop/ (“channels”)
- At events and festivals where we may have a facility, stall or table.
- Our products may also be available from various licenced third parties, including retailers and online stores.
- These terms and conditions apply only to products purchased directly from us, and not to any of our products which you may have purchased from any third party. Such transactions are subject to the terms and conditions of the respective third party.
- We take all reasonable measures to accurately reflect the description, availability, purchase price and delivery charges of products on the website. Should however there be any errors, we shall not be liable for any loss, claim or expense relating to a transaction based on any error, other than to refund you for any amount already paid.
- Deep South Distillery shall not be bound by any incorrect information regarding our products displayed on any third party websites.
General conditions of sale
- Persons under 18: We will not sell any alcoholic product to any person under the age of 18. We reserve the right to request proof of your age at point of purchase, or, in the case of deliveries, at point of delivery.
- Limitation of quantities: We reserve the right to limit the quantities for sale of any item, or to withdraw any item from sale at our sole discretion at any time, without notice and without recourse.
- Intoxicated persons: We will decline to sell alcoholic products to any person who is intoxicated or under the influence of alcohol.
- Payment Methods: We accept payments made (“payment methods”)
- in cash
- with selected Visa or MasterCard bank cards
- by direct debit or bank transfer directly into our bank account (“EFT”), the details of which will be provided on request
- via selected payment gateways and payment methods as we may provide from time to time for the convenience of our customers
Not all payment methods will be available everywhere we trade.
- Payment in Full: We reserve the right to withhold any product until payment in full becomes irrevocable or reflects in our bank account, for example where we receive notification from our bank or payment gateway that payment has finalised.
- Card Information: We do not store credit card details anywhere on our website or at the point of sale. Card transactions are acquired for Deep South Distillery via selected reputable payment gateways, for example Payfast, Yoco or Snapscan, who are approved for all South African Acquiring Banks. Users may obtain and view the relevant security certificate and security policies from these gateways, for example at www.yoco.com/za/legal or payfast.co.za
- Customer Information: We do not collect customer personal information at point of sale. We collect and store information on our online shop for the purposes of processing the sale and delivering the order. Please refer to our Privacy Policy for more details..
- Transaction currency: Transaction currency is South African Rand (ZAR) except where explicitly stated.
- Bank charges: Where an EFT payment is made, any bank charges are purely for the account of the sender. We will not be able to supply or deliver the product until the full sale amount is received in our bank account.
- Delivery Locations: We deliver to all urban centres in South Africa, using the services of reputable courier companies. We will decline an order if we are unable to deliver to your area.
- Delivery Schedule: We endeavour to despatch an order on the first business day after the day on which the order was received. If you are in an urban centre, you should receive your order within 1-3 working days. If you have an outlying or rural address, and our courier offers a service there, delivery may take up to 7 working days.
- Delivery Charge: A delivery charge will be calculated and charged to the bill or added to the order total at time of order.
- Responsibility to Accept: We will only be held responsible for the goods that are signed for on the invoice and collection note. It is your responsibility to
- ensure that there will a person at your premises or venue who is available to sign receipt on delivery of the goods.

- sign the delivery documents to indicate you have received the products.
- Foreign Deliveries: Delivery outside of South Africa may be possible by special arrangement, provided that our courier companies are able to make the delivery. You are advised that this usually involves significant costs and duties.
Return and Refund Policy
- Cancellations: You may cancel an order you have placed with us by advising us by email. If we receive that email before we have despatched the order, we will then issue you a full refund within 2 working days or less.
- Shipping costs: If we have already despatched the order to you, you may still cancel the order and return the stock to us within the time limit for returns, but you will be responsible for the shipping costs and risks of returning the product to us.
- Time Limit for Returns: You may elect to return your order within 15 days from date of purchase for an exchange or refund. After this time has elapsed we cannot process returns or refunds.
- Condition of returned goods: To be eligible for a full or partial refund, replacement or exchange, the item must be unused (unopened and with anti-tamper seals intact), in the same condition that you received it, in the original packaging and accompanied by the original invoice or order confirmation.
- Returns Request process: To return a product, please complete the form at deepsouthdistillery/product-returns, or request that we email it to you. When you return a product, please advise us whether you want a refund, to exchange the product or a replacement. We will require the following information
- The original invoice or order confirmation
- Your name, email address, phone number and delivery address if these details are different from the invoice or confirmation.
- The circumstances that led to your return request
- Damaged goods: We take exceptional care in the manufacture, packaging and shipping of all of our products. However, if your order is visibly damaged or if the parcel appears to have been tampered with, we will replace the product at no cost to you. We request that you take a picture of the damage and make a note on the delivery documents before you sign them. This information is needed in order to process the replacement. If we are unable to replace the product, you may request a substitute product to the same value, or elect to receive a refund.
- Process for return of damaged goods: When you notify us of damaged goods, we will send you information about how the item should be returned to us. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your return request, and how and when your refund or replacement will be processed.
- Refunds: Any refunds will only be done using the same payment method that was used to make the purchase, and using the same card or bank account.
